Equity/Division of Property

In Massachusetts the issue of property division for separated unwed/unmarried couples, whether gay or straight, is within the jurisdiction of the Equity Division of the Probate and Family Court, The Medford Family Law Attorneys are experienced in assisting clients to obtain fair and timely resolution of these issues.  This experience includes assisting a client regain possession of his home, work tools and personal property through separate Paternity, Equity and District Court Landlord/Tenants  actions.  By coordinating these actions, in three separate courts, suits, through years of experience working in these courts we were able to efficiently assist the client to reach a successful result.

Paternity

Issues dealing with children born out of wedlock and the formal establishing of the child's parentage are litigated  through the Paternity Department of the Probate & Family Court.  The Medford Family Law Attorneys at the Law Office of Kevin P. O'Malley are experienced effective and empathetic in handling all aspects of paternity cases.  Whether it is finding and prosecuting an absent father to establish his duty to support his child, establishing a caring father's right to see his child or securing medical insurance coverage for the mother and child through the putative father's work policy, we will approach the matter with as much intensity and vigor as the client dictates.

Child support in Paternity cases is distinguished from marital child support cases in that the child support order can be retroactive back to prenatal costs. Thus if the child is three years old, the order could be retroactive back three years for support and could reimburse the mother for a portion or all of her medical costs related to the bearing and delivery of the child. There could be a lot at stake in such matters.
